Our Family Law Attorneys advise that chapter one of the Texas Family Code makes it clear that licensed ceremonial marriages in the State of Texas are presumed valid. It is a long standing public policy in Texas to uphold and defend marriages because of the value they provide to the community. There are very limited circumstances when a licensed ceremonial marriage can be attacked as invalid. Those exceptions will be addressed in a separate video, and are found in chapter six of the Texas Family Code.
If a person has been married more than once, the most recent marriage is presumed valid. Family Law Attorneys advise the presumption of validity is rebuttable, but Texas’ Courts are required to presume the most recent marriage is valid.
